Uber is one of the most popular transportation services in the world. Anyone with a license and a car can join the network of Uber drivers. The latter are not compelled to undergo any special training or qualifications. Uber is one of the first companies to implement the rideshare concept on a mass scale. For the most part, such crowd-sourced taxi service works. Most Uber drivers want to get good ratings from their passengers to get more business, and so they make a point of being safe and conscientious drivers. Other drivers are not so cautious. They take advantage of the largely unregulated status of Uber drivers to do things that increase the risk of an accident.

If you have been injured in an accident owing to the negligence and reckless of an Uber driver, you do have legal options.

Your First Call

After a car accident you will need to be treated for your injuries. You will be approached by an insurance adjuster soon afterward. Say nothing to anyone without first speaking to a lawyer such as the ones found at Neufeld, Kleinberg, and Pinkiert, PA. Indeed, once you have contacted your loved ones, your next call should be to a lawyer.

The aim of the insurance company, which will be representing Uber, is to look out for their own interests. The purpose of your lawyer is to look out for yours. Your lawyer will want to set down what you recall of the accident while it is still fresh in your memory. They will also want to know the extent of your injuries and your prognosis. This will help them put together the beginnings of a legal strategy.

Uber’s Standard Offer

All Uber drivers are covered under the company’s 1 Million Dollar insurance policy. No matter the personal insurance of the driver, you as an accident victim will receive at least a $1,000,000 no matter who was at fault for the accident.

Your Legal Options

Most people who have been involved in Uber accidents accept the million dollars and go no further. However, if the accident was especially bad and your injuries catastrophic you may consider suing the company for more. If you can prove that the Uber driver’s recklessness caused the accident, you may have a good case to make.

Much of the law and precedent related to rideshare torts has yet to be created. However, there have been cases in which plaintiffs have been awarded more money. To get anything over a million dollars, you must prove that your injuries are a direct result of the recklessness of the Uber driver and that they are life threatening. If your doctors tell you that you will need years of treatment to get fully healthy, then you may have a case. If your injuries prevent you from going back to work or result in some permanent disability, then you may succeed in your suit.

Whatever you decide to do, you should first think it through with your lawyer.
